TENANT CONNECT - END USER LICENSE AGREEMENT (EULA)

PLEASE READ THIS END USER LICENSE AGREEMENT ("AGREEMENT") CAREFULLY BEFORE DOWNLOADING OR USING THE TENANT CONNECT APP.

1. ACKNOWLEDGMENT

This End User License Agreement ("EULA") is a legal agreement between you (the "End-User") and InspectingSmart Pty Limited (ABN: 70 668 971 024) ("Developer", "we", "us", or "our"). For Apple App Store users, you acknowledge that this EULA is concluded between you and InspectingSmart Pty Limited only, and not with Apple. For Google Play Store users, you acknowledge that this EULA is between you and InspectingSmart Pty Limited, with additional terms from Google Play's Terms of Service. InspectingSmart Pty Limited, not Apple or Google, is solely responsible for the Tenant Connect application ("App") and its content.

2. SCOPE OF LICENSE
The license granted is:
- Non-transferable
- For Apple users: Limited to use on Apple-branded products you own or control, subject to the Usage Rules in the Apple Media Services Terms and Conditions, and accessible by other accounts via Family Sharing or Legacy Contacts
- For Android users: Limited to use on Android devices you own or control, subject to Google Play's Terms of Service
- For personal use as either a property manager, landlord or tenant for onsite and remote property condition inspections

3. MAINTENANCE AND SUPPORT
- InspectingSmart Pty Limited exclusively provides all maintenance and support services for the App
- Support available at: https://tenantconnect.com.au/contact
- Neither Apple nor Google has any obligation to provide maintenance or support services
- Technical requirements: mobile phones only (not tablets), stable internet connection for saving inspection data and video calls

4. WARRANTY
- The App is provided "as is" and "as available"
- InspectingSmart Pty Limited is responsible for addressing any warranties
- For Apple users: If the App fails to conform to any warranty, you may notify Apple, and Apple will refund the purchase price
- For Android users: Refunds are handled according to Google Play's refund policy
- All other warranty claims are InspectingSmart Pty Limited's sole responsibility

5. PRODUCT CLAIMS
InspectingSmart Pty Limited, not Apple or Google, is responsible for addressing:
- Product liability claims
- Any claim that the App fails to meet legal/regulatory requirements
- Claims under consumer protection or privacy legislation
- Claims related to onsite and remote property inspections, and data storage
- Any other claims related to your use or possession of the App

6. INTELLECTUAL PROPERTY RIGHTS
- InspectingSmart Pty Limited will handle any third-party intellectual property infringement claims
- All App content and features are proprietary to InspectingSmart Pty Limited
- Users retain rights to their property-specific content and inspection data

7. LEGAL COMPLIANCE
You represent and warrant that:
- You are not in a U.S. Government embargoed region
- You are not on any U.S. Government prohibited/restricted parties list
- You will comply with Australian and applicable international laws

9. THIRD PARTY TERMS
You must comply with:
- Your mobile data/internet service provider agreements
- For Apple users: Apple’s Media Services Terms and Conditions
- For Android users: Google Play Terms of Service
- Applicable privacy and data protection regulations
- Any other relevant third-party terms

10. THIRD PARTY BENEFICIARY
- For Apple users: Apple and its subsidiaries are third-party beneficiaries of this EULA with the right to enforce it
- For Android users: Google and its subsidiaries are third-party beneficiaries of this EULA with the right to enforce it


11. APP-SPECIFIC TERMS
- Both landlords and tenants must install the App on smartphones
- Separate accounts required for landlord and tenant roles
- Video calls require adequate internet connectivity
- Inspection data is encrypted and stored securely
- Users must configure correct time zones for scheduling
- Multiple properties can be managed within a single account
- Tenants have 7 days after taking possession of the residential premises post-Moving In inspection for indication of agreement or disagreement with the condition of the landlord or landlord’s agent

12. DATA AND PRIVACY
- All data transmission is encrypted
- Video calls are stored securely
- Inspection reports are protected
- Privacy Policy available at https://tenantconnect.com.au/privacy-policy

13. TERMINATION
This license is effective until terminated. Your rights will terminate automatically without notice if you fail to comply with any terms.
